Plea conviction and sentencing of defendant on an assortment of criminal charges are upheld as modified because: 1) part of defendant's sentence to which he agreed is based on an enhancement with which he was never charged, and which he did not admit committing; and 2) a waiver of his right to appeal was not knowing, intelligent, or voluntary.
