California Court of Appeal

Gonzalez v. Chen, B227444

In a dispute concerning the award of attorney's fees under the Medical Injury Compensation Reform Act (MICRA), Bus. and Prof. Code, section 6146(a), judgment of the trial court is reversed because the court may award fees pursuant to the applicable California Rule of Court, Rule 7.955, not the local court rule that was preempted at the time of the award, and is not required to award the maximum contingency fees allowed under MICRA.
