California Court of Appeal

Newlife Sciences v. Weinstock, B223212

In an action arising from the enforcement of a non-compete clause, judgment of the trial court granting a preliminary injunction in favor of the plaintiff is affirmed where the court properly granted terminating sanctions and found that the likelihood that the plaintiff will ultimately prevail is sufficiently great that it substantially reduced the severity of the harm the plaintiff must show to prevail on its motion for injuctinve relief.
