In a wrongful death action alleging that the defendant's 13-year sexual abuse of his step daughter, plaintiff's daughter, was the cause of step daughter's suicide, summary judgment in favor of the defendant is reversed where trial erred in suppressing the contents of a telephone conversation which on admission creates a triable issue of fact.
