California Court of Appeal

People v. Vangelder, D059012

In a DUI dispute involving whether the trial court erred in excluding expert testimony that would have demonstrated some unreliability in breath testing devices, judgment of the trial court is reversed because it did not have a sufficient basis in the evidence to reach its conclusion, and where it prejudicially erred in excluding evidence about the quality of the sample taken by either an electrochromatograph/infrared or preliminary alcohol screening breath devices.
