Citizens for a Better Eureka v. California Coastal Commn., A129873

In a petition for a writ of mandate concerning the jurisdiction of the defendant over the initial phase of a proposed mixed-use development project and involving the scope of Public Resources Code section 30005(b), judgment of the trial court denying petition is affirmed because section 30005 (b) authorizes developments that are confined to nuisance abatement to proceed without a coastal development permit (CDP), but where the development, as in the instant case includes, but is not limited to, nuisance abatement, a CDP is required.
