California Court of Appeal

Van Sickle v. Gilbert, C062657

In an action for accounting and breach of fiduciary duty, judgment of the trial court is reversed because although the court did not abuse its discretion in imposing a terminating sanction on defendant, default judgment and default must be set aside because plaintiff could not take defendant's default until she put him on notice of the amount of money sought in the action, which she failed to do.
