California Court of Appeal

Dacey v. Taraday, A125080

In a creditor's claim arising from an agreement concerning the dissolution and winding-up of a law firm and the assignment of legal interests in ongoing litigation, judgment of the trial court is affirmed where it properly interpreted the dissolution agreement to find that assigned legal interest was not partnership asset and thus susceptible to unilateral modification, and where plaintiff's claim was not barred by Code of Civil Procedure section 366.2(a).
