California Court of Appeal

Adoption of B.C., E051664

In a motion to set aside an adoption on the basis of extrinsic fraud, judgment of the family court denying motion as time-barred, Family Code section 9102, is affirmed because section 9102 applies to any action or proceeding to set aside an adoption order on any grounds including extrinsic fraud, and where, on the facts of the case, section 9102 does not violate due process even when applied to a claim that an adoption order is void due to lack of notice and lack of consent.
