California Court of Appeal

Dacey v. Taraday, A125080

In an action alleging breach and rescission of a dissolution agreement between two former law firm partners, judgment of the trial court is affirmed because an administrator of an estate has the authority to renegotiate a fee agreement despite a dissolution agreement where agreement expressly transfers legal interest in the subject litigation to the deceased partner, and that the parties' course of conduct indicated so.
