Conviction and sentencing of defendant for computer hacking-related offenses are upheld where: 1) defendant lacks standing to challenge a search warrant served on an Internet Service Provider (ISP) because an internet service subscriber has no expectation of privacy in the subscriber information he supplies to the ISP, and 2) the absence of an incorporation by reference clause for an exhibit to a search warrant affidavit is not a substantial defect.
