California Court of Appeal

In re Vicks, D056998

In a petition for habeaus relief from the denial of parole by the Board of Parole Hearings, petition is granted in part where decision to deny parole was properly supported by some evidence, but the application of Marsy's Law, Penal Code section 3041.5(b), to petitioner's application and to inmates whose commitment offense was committed prior to the effective date of the law violates ex post facto principles.
