Conviction and sentencing of defendant on an assortment of charges relating to his rape of his former spouse is affirmed as modified where: 1) trial court properly ordered the disclosure of documents defendant brought with him to the witness stand to refresh his recollection, over his objection that they were protected by the attorney-client privilege; and 2) the enhancement for administering Ambien as a controlled substance for the purpose of committing sexual penetration was also proper.
