In a class action for breach of fiduciary duty and other related claims alleging misappropriation of a settlement fund by defendant, summary judgment in favor defendant is reversed because judgment by trial court that since the statute of limitations barred causes of action in the underlying litigation, plaintiff could not prevail on his causes of action as a matter of law, is erroneous.
