California Court of Appeal

Digerati Holdings, LLC v. Young Money Entertainment, LLC, B218639

In a dispute involving an action for breach of an entertainment contract relating to the production of a documentary film, judgment of the trial court granting in part a special anti-SLAPP motion by defendant is affirmed where: 1) the gravamen of the breach of contract count is the failure of the defendants to comply with an express contractual obligation and thus, that count, does not arise from protected activity; but 2) a second count for breach of an implied covenant of good faith and fair dealing is based primarily on a separate, protected conduct.
