California Court of Appeal
People v. Moomey, E049827
Conviction and sentencing of defendant for being an accessory after the fact, Penal Code section 32, is upheld as modified because: 1) conviction rested on sufficient evidence; 2) there is no reasonable likelihood the jury misunderstood ambiguous instructions; 3) flight instruction was proper; and 4) delegation of the calculation of conduct credits to the Department of Corrections and Rehabilitation was erroneous.
