California Court of Appeal

Cuiellette v.City of L.A., B224303

In a dispute involving the scope of the California Fair Employment and Housing Act (FEHA), Government Code section 12900, et seq, judgment of trial court in favor of plaintiff on his claims of disability discrimination and failure to accommodate a disability by the defendant is affirmed, where substantial evidence supports judgment, because even if defendant could not perform all of the essential functions of his employment, he could perform the essential functions of a position into which he had been placed, the termination of which violated the FEHA.
