Conviction and sentencing of defendant on five counts of lewd and lascivious behavior with a child under the age of 14, PC section 288(a), is upheld where an amended criminal complaint midtrial adding additional counts for which defendant was convicted and ruling on a section 1118.1 motion in the presence of the jury coupled with a failure to give a unanimity instruction as requested by defendant were not prejudicial errors.
