California Court of Appeal
JSM Tuscany v. Superior Court, B227360
In a petition for a writ of mandate, judgment my trial court denying motion to compel arbitration is affirmed because, although a nonsignatory plaintiff can be compelled to arbitrate a claim against a nonsignatory defendant, when the claim is itself based on, or inextricably intertwined with, the contract containing the arbitration clause on the limited facts of the case, it is unclear whether agreements in dispute are inextricably intertwined.
