In a childhood sexual abuse case in which plaintiff did not file a complaint in accordance with the process outlined in Code of Civil Procedure section 340.1, denial of plaintiff's motion for relief pursuant to section 473 is affirmed over claims that the court: 1) erred by considering defendant's untimely demurrer; 2) abused its discretion by sustaining the demurrer without leave to amend; and 3) abused its discretion by denying relief pursuant to section 473.
