Blue Shield of California Life & Health Ins. Co. v. Superior Court of Los Angeles County (Kawakita), B225632

In a tort action for bad faith breach of a health insurance policy the plaintiff and real party in interest obtained from Blue Shield, a petition seeking writ of mandate directing the trial court to reverse its order denying defendant's motion for summary adjudication on statute of limitations grounds, is denied where defendant, as permitted by law, drafted a more favorable provision that gave plaintiff three years to sue for a tortious breach of the implied covenant of good faith and fair dealing.
