California Court of Appeal
People v. Ochoa, B218800
Conviction of defendant for being a felon in possession of a firearm in a second trial after the jury failed to reach a verdict in the first trial, is affirmed where: 1) contrary to defendant's argument that, under the doctrine of collateral estoppel, the ruling on his probation barred the second trial, the decision at the revocation hearing did not bar defendant's second trial; and 2) there is no basis to disturb the trial court's ruling on the Pritchess motion.
