California Court of Appeal
People v. Valenzuela, C061539
In a conviction of defendant for second degree burglary and grand theft, trial court's determination that defendant was previously convicted of a "serious" felony within the meaning of the three strikes law and thus the prior conviction qualified as a "strike," is reversed as the record contains insufficient evidence to support a finding that defendant's prior conviction for reckless driving was for a serious felony.
