Mental Health Ass'n in California v. Schwarzenegger, A125937
In a petition for a writ of mandate brought by several organizations dedicated to providing advocacy, education and support services in the field of mental health and several individuals, to compel the State of California to reinstitute the Homeless Adults Program, which was removed by the state budget as the result of a gubernatorial veto in 2007, trial court's denial of the petition is affirmed where: 1) the elimination of funding does not violate the continuing support requirement of section 5891; 2) the elimination of funding does not violate the structure requirement of section 5891; and 3) plaintiffs' argument that the trial court erroneously excluded evidence tending to show the accomplishments of the AB 2034 program and the increase of indirect costs to the counties as a result of the program's elimination is rejected.
