California Court of Appeal

People v. Ramirez, B218413

Defendant's convictions for murder and firearm offenses are reversed with respect to the murder conviction as the evidence against defendant was not so overwhelming as to show there is no reasonable probability that he would have obtained a more favorable result if the jury had been instructed concerning voluntary manslaughter on a heat of passion theory.
