Laswell v. AG Seal Beach, LLC., B221481

In plaintiff's suit against a health facility and other defendants for elder abuse and related claims, trial court's order denying defendants' petition to compel arbitration is reversed and remanded where: 1) California has a strong public policy favoring contractual arbitration and thus requiring enforcement of valid arbitration agreements; and 2) Code of Civil Procedure section 1281.2(c)'s exception to enforcement of arbitration agreements does not apply here and thus the trial court did not have discretion to deny the petition to compel arbitration.
