California Court of Appeal

People v. Johnson, A124362

In a prosecution of defendant for being a felon in possession of a firearm and possession of ammunition by a felon, trial court's admission of an audiotape of a 911 call made by defendant's wife on the night of the incident is affirmed as the wife's statements in her 911 call were nontestimonial, as statements made immediately after, and in response to, a violent assault should be treated as presumptively made during a contemporaneous emergency.
