People v. Russell, D054408

Conviction of defendant for first-degree murder, evading an officer and causing serious bodily injury or death, residential burglary, and vehicle theft, as well as a sentence of 26 years to life, are affirmed where: 1) the escape rule applies to the crime of burglary whether or not anyone was home at the time that the burglary was committed; 2) there is substantial evidence to support the felony murder conviction; and 3) defendant's sentence is not cruel or unusual.
