California Court of Appeal
Henderson v. Pac. Gas & Elec. Co., F058002
In plaintiff's suit against her former employer, PG&E, claiming employment discrimination in violation of the California Fair Employment and Housing Act (FEHA) and breach of contract, trial court's denial of plaintiff's motion to vacate the order on the motion for summary judgment and resulting judgment under section 473(b) is affirmed where: 1) trial court did not abuse its discretion in denying plaintiff's request for discretionary relief under section 473(b) from entry of summary judgment in favor of PG&E as plaintiff's counsel's mistakes were inexcusable mistakes; and 2) plaintiff is not entitled to mandatory relief under section 473(b) because such relief is not available for summary judgments.
