California Court of Appeal
La Serena Properties v. Weisbach, A126283
In plaintiffs' suit against an abitrator and the American Arbitration Association for damages as well as other relief, alleging that the arbitrator failed to disclose a certain conflict of interest during the appointment process, judgment of the trial court is affirmed where defendants are protected from liability by the common law arbitral immunity for quasi-judicial acts, as the alleged claims of misconduct all arise out of the conflict of interest disclosure procedure that is integrally part of the arbitration process.
