California Court of Appeal

A conviction of an inmate for making criminal threats against a correctional officer and other related crimes is affirmed where: 1) defendant's conviction for making criminal threats against correctional officer is supported by substantial evidence because the nature and circumstances of the threat showed that it was "so unequivocal, unconditional, immediate, and specific as to convey to the person threatened, a gravity of purpose and an immediate prospect of execution of the threat"; and 2) defendant's conviction for violating section 76 is supported by substantial evidence as the officer is in the class of persons covered by that section.
