Molecular Analytical Sys. v. Ciphergen Biosystems, Inc., H032845
In plaintiff's suit for breach of contract and other claims, involving licensing of technology rights and assignment of those rights, trial court's denial of defendant's motion to compel arbitration is reversed and remanded with instructions to enter a new and different order granting defendant's motion to compel arbitration where: 1) plaintiff cannot avoid arbitrating its claims against the signatory defendant because those claims are within the reach of the arbitration clause; and 2) plaintiff cannot avoid arbitrating its claims against the nonsignatory defendant because those claims are inextricably bound up with the obligations arising out of the agreement containing the arbitration clause.
