Arthur v. Dep't of Motor Vehicles, D055494
Trial court's denial of a petition for a writ of mandate to set aside the Department of Motor Vehicles' (DMV) suspension of petitioner's driver's license for driving with a blood alcohol content of .08 percent or greater is affirmed as substantial evidence supported the trial court's finding that the sobriety checkpoint was in substantial compliance with the factors set forth in Ingersoll v. Palmer, and was thus constitutional.
