California Court of Appeal

Conviction of defendant for conspiracy to commit murder and the jury's finding that the offense was committed for the benefit of, at the direction of, or in association with, a criminal street gang is affirmed where: 1) wiretaps were obtained legally and minimized in accordance with the relevant statutes; 2) the court committed error when it did not require the state to provide timely reports to the court under section 629.60 and to file an application to use nontargeted intercepted communications as soon as practicable as required by 629.82(a)(1), but the error was harmless; 3) the court did not err in denying defendants' motion to suppress wiretap evidence under section 1538.5; and 4) defendant's remaining claims are rejected.
