California Court of Appeal

Melton v. Boustred, H033148

In plaintiffs' suit against a host of a party for being attacked, beaten, and stabbed by a group of unknown individuals, trial court's order sustaining a demurrer without leave to amend is affirmed where: 1) plaintiffs' negligence claims fail because defendant did not owe plaintiffs a duty of care; 2) plaintiffs' nuisance claim fails as it merely restates their negligence claims; and 3) amendment cannot cure defects in plaintiffs' complaint.
