California Court of Appeal
Mendoza v. ADP Screening & Selection Servs., Inc., B214653
In plaintiff's action for damages against a business involved in conducting a pre-employment background check for employment purposes, claiming various causes of action when it republished information on the Megan's Law website (MLW) to its clients, grant of defendant's anti-SLAPP motion is affirmed where: 1) an employee-screening business has a constitutional free speech right - as such rights are defined in the anti-SLAPP statute - to republish information disclosed on the MLW to the business's clients, notwithstanding the statutory prohibitions on the use of such information; and 2) the trial court properly granted defendant's anti-SLAPP motion to strike an MLW-based complaint for damages on the ground that plaintiff could not show as a matter of law a probability of prevailing.
