California Court of Appeal

Trial court's grant of a petition for writ of mandate prohibiting Governor Schwarzenegger and the director of the Department of Personnel Administration (DPA) from implementing furloughs for employees of the State of Compensation Insurance Fund (SCIF) is affirmed where: 1) the court did not err in refusing to stay the present action awaiting the results of an appeal in the Sacramento proceedings; and 2) trial court's conclusion that Ins. Code section 11873(c) limits the Governor's ability to impose furloughs on SCIF employees is consistent with the language of the statute, the larger statutory scheme, and the legislative history of the SCIF authorizing legislation.
