California Court of Appeal

In re H.D., H033462

Juvenile court order committing minor to the Department of Corrections and Rehabilitation is reversed and remanded where there is a discrepancy between the court's oral pronouncement and the written orders and it is unclear whether the juvenile court at what length the court intended to fix the minor's term of maximum physical confinement, and whether the court understood it had the discretion to impose a maximum term other than the lower or middle term set by Penal Code sec. 213.
