California Court of Appeal
In re Branden O., A123065
Juvenile court order making the minor a ward of the court with no termination date and placing the minor on probation subject to various terms and conditions for committing misdemeanor assault with a stun gun is affirmed where: 1) there was sufficient evidence that the stun gun at issue was capable of temporarily immobilizing a person, and substantial evidence supports the court's finding that the minor violated Penal Code sec. 244.5; and 2) the court did not abuse its discretion in admitting a police officer's testimony.
