California Court of Appeal

Eric M. v. Cajon Valley Union School Dist., D053534

In a negligence action for personal injuries, trial court's grant of summary judgment for defendant is reversed where: 1) the trial court incorrectly determined that defendant did not owe plaintiff a duty of reasonable care during the events leading up to his injuries after school and off campus; 2) triable issues of fact remain about whether defendant fulfilled its duty to exercise reasonable care in permitting plaintiff to leave the bus while it was parked on school premises.
