Petition for habeas relief is granted and the Governor's parole decision vacated where there was no evidence in the record that was before the Board of Parole Hearings and the Governor supporting a conclusion that due to the nature of his commitment offense alone, petitioner currently poses an unreasonable risk of danger to society if released. The Board's decision granting plaintiff parole is reinstated.
