In an action involving the forfeiture of a bail bond, trial court's denial of defendant's motion to set aside summary judgment, discharge the forfeiture and exonerate the bail is reversed where, when defendant was brought in on an unrelated offense, he was under arrest or on hold within the meaning Penal Code section 1305, and thus the earlier forfeiture of his bail bond should have been set aside.
