California Court of Appeal
Estate of Prindle, C055832
In a probate action, probate court ruling against insurance company is affirmed where: 1) the court did not abuse its discretion in determining that insurance company had standing to petition the court; 2) the court properly determined that insurer was estopped from asserting that plaintiff failed to file a timely claim against the estate; and 3) the provisions of Probate Code section 550 relating to limitation of damages did not apply, and thus insurer's argument that recovery must be limited to the amount of decedent's insurance coverage was without merit.
