In an employment action, trial court's grant of defendant's motion for summary judgment is affirmed where: 1) the trial court properly rejected defendant's claim that plaintiff was required to exhaust internal administrative remedies prior to filing suit as plaintiff's claim he suffered discrimination based on whistleblowing is not governed by the internal rules on which the defendant relies; 2) three of plaintiff's claims failed to state a cause of action; and 3) there were no triable issues of material fact with respect to plaintiff's other claims as defendant met its burden to show a legitimate justification for its employment decisions, and plaintiff failed to raise a triable issue as to pretext.
