California Court of Appeal

Sanchez v. Western Pizza Enter., Inc., B203961

In a dispute over an arbitration agreement, denial of defendant's motion to compel arbitration is affirmed where: 1) the trial court did not abuse its discretion in holding that the class arbitration waiver is contrary to public policy and unenforceable; 2) the arbitration agreement itself was substantively unconscionable and unenforceable for both the class arbitration waiver and its unconscionable arbitrator selection clause.
