Peak-Las Positas Partners v. Bollag, B205091

In a land sale action, trial court's judgment against defendant is affirmed where defendant acted unreasonably and in bad faith in refusing to extend the escrow on a land sale contract after plaintiff paid most of the purchase price and incurred about $5 million in costs for a lot line adjustment, and was bound by an implied covenant of good faith and fair dealing not to do anything that would destroy or injure plaintiff's rights under the purchase agreement.
