California Court of Appeal

Larry Menke, Inc. v. DaimlerChrysler Motors Co, G039686

In a dispute over a franchise transfer, trial court order sustaining defendant's demurrer is affirmed where: 1) the plain terms of the Vehicle Code provision plaintiff relied on do not include prospective franchise transferees, and thus, plaintiff has no cause of action on his statutory claim; and 2) plaintiff alleged no interference or tortious conduct independent of the putative violation of the Vehicle Code.
