McCoy v. Progressive West Ins. Co., B199978
In a bad faith insurance action based on a car theft, judgment for plaintiff is affirmed where: 1) there is no authority for a jury instruction on the "genuine dispute" doctrine; and 2) the trial court properly excluded evidence of plaintiff's prior fraud and domestic violence, and recordings of defendant-insurer's claim investigation.
