In an action by plaintiff-podiatrist calling for defendant-director of Department of Health Care Services to reconsider plaintiff's application for reenrollment as a provider for Medi-Cal services without regard to plaintiff's outstanding liability for an overpayment made to him, denial of petition to provide plaintiff opportunity to contest the audit determination on the merits is affirmed where: 1) plaintiff failed to establish the invalidity of the prior judgment; and thus, 2) plaintiff was not entitled to relief on the merits of his claim.
