In case involving the eviction of plaintiff-tenant from a rent-controlled apartment, grant of a strategic lawsuit against public participation (SLAPP) motion contending that plaintiff-tenant's complaint arose from defendant-landlord's privileged communications made in the course of proceedings is reversed where: 1) tenant's claim did not arise from a protected activity; and 2) tenant's claims were based on the landlord's violation of rent control laws, not on acts in furtherance of the right of free speech or petition.
